國家發(fā)展改革委、商務(wù)部12月27日對(duì)外發(fā)布《外商投資準(zhǔn)入特別管理措施（負(fù)面清單）（2021年版）》和《自由貿(mào)易試驗(yàn)區(qū)外商投資準(zhǔn)入特別管理措施（負(fù)面清單）（2021年版）》，自2022年1月1日起施行。這是我國連續(xù)第五年縮減全國和自貿(mào)試驗(yàn)區(qū)負(fù)面清單。

　　The National Development and Reform Commission and the Ministry of Commerce on December 27 unveiled the Special Administrative Measures on Access to Foreign Investment (2021 Edition) and the Free Trade Zone Special Administrative Measures on Access to Foreign Investment (2021 Edition), both of which will take effect on January 1, 2022. This marks the fifth consecutive year that China has shortened its national negative list and pilot free trade zone (FTZ) negative list.

　　【知識(shí)點(diǎn)】

　　外資準(zhǔn)入負(fù)面清單是我國實(shí)行準(zhǔn)入前國民待遇加負(fù)面清單管理制度的根本依據(jù)。負(fù)面清單以外的外商投資，按照內(nèi)外資一致原則管理，給予國民待遇。各地區(qū)、各部門不得在負(fù)面清單之外的領(lǐng)域單獨(dú)針對(duì)外資設(shè)置準(zhǔn)入限制。

　　2017年至2020年，我國連續(xù)四年修訂全國和自貿(mào)試驗(yàn)區(qū)負(fù)面清單，外資準(zhǔn)入特別管理措施分別由93項(xiàng)、122項(xiàng)減至33項(xiàng)、30項(xiàng)。2021年版全國和自貿(mào)試驗(yàn)區(qū)外資準(zhǔn)入負(fù)面清單，進(jìn)一步縮減至31條、27條。此次縮減進(jìn)一步深化制造業(yè)開放，在自貿(mào)試驗(yàn)區(qū)探索放寬服務(wù)業(yè)準(zhǔn)入，并提高外資準(zhǔn)入負(fù)面清單精準(zhǔn)度，優(yōu)化外資準(zhǔn)入負(fù)面清單管理。

　　中國已批準(zhǔn)《區(qū)域全面經(jīng)濟(jì)伙伴關(guān)系協(xié)定》，并申請(qǐng)加入《全面與進(jìn)步跨太平洋伙伴關(guān)系協(xié)定》，將在履約和談判進(jìn)程中繼續(xù)壓減外資準(zhǔn)入負(fù)面清單，推動(dòng)農(nóng)業(yè)和制造業(yè)全方位開放，加大服務(wù)業(yè)開放力度，依法給予內(nèi)外資企業(yè)同等待遇。

　　China has ratified the Regional Comprehensive Economic Partnership (RCEP), and it has applied for joining the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP). In the course of RCEP implementation and CPTPP negotiation, China will continue to shorten the negative list on foreign investment, promote all-round opening-up of its agricultural and manufacturing sectors, expand the opening of the service sector, and treat domestic and foreign businesses as equals in accordance with law.
